Denise DeJohn Sworn as Village of Angola Trustee
Village of Angola Mayor Howard (Hub) Frawley, newly sworn Village Trustee Denise DeJohn and her husband Sam DeJohn. The Angola Village Board met on Tuesday, September 4, 2007. Trustee Jim Carlson was excused. Denise DeJohn was appointed as trustee to fill the remainder of Mike Stockman’s term. Mr. Stockman had resigned at the prior meeting because he was moving out of the area. Trustee DeJohn will assume all of the duties that had been Stockman’s with the exception of Fire Department liaison which will become Trustee John Wilson’s responsibility. R.D. McPeek addressed the Board about a building permit. At the last meeting he inquired about the cost of the permit for Bob’s Angola Variety. Since there had been no alterations to the building at 48 N. Main Street, he wanted to know why a permit for $262 for commercial building alterations was required. The Board had received a letter from Building Inspector Chuck LaBarbera stating the permit fees that at 3 other businesses that had recently been opened had been charged. LaBarbera also stated that in January the Village fee schedule had changed and he noted the charges those same businesses would have paid if they were getting their permits today. McPeek stated that major alterations had been made to the buildings those businesses were occupying and he was not opposed to building permits when they were warranted. LaBarbera then stated that the McPeek had been given information about the New York State codes and he (LaBarbera) was referring to Chapter 26 of the local codes. LaBarbera is to meet with Village Attorney Andy Yusick to review the matter and Yusick is then to meet with McPeek to explain the outcome. A resident from High Street addressed the Board about the problem of skate boarding and BMX bike riding in the Village’s no skateboarding zone. Trustee William Houston responded that when the skateboarding happens in the Village business district, residents should call the police who will confiscate the skateboard requiring the parent/guardian to go to the Police Department to retrieve the skateboard. The third offense would also incur a $250 fine. Trustee Bill Houston reported that Angola resident Eber Inman was recognized by Rural Transit for his service as handicap van driver. Houston attended a meeting of Erie County Towns and Villages where they discussed the County’s sharing of the 1% sales tax. The consensus was that the County should leave the distribution the way it is so that each community will get their share. Houston asked for ideas for the Community Development Block Grant (CDBG) project for the upcoming year. This year’s award will be $100,000. Houston asked to be excused from the next Board meeting as he will be out of town at a NYCOM (New York Conference of Mayors) Conference. Trustee John Wilson reported that he would be sending letters to the railroad this week regarding the bridge over Big Sister Creek and its need of repair. Wilson also has a couple of ideas for the upcoming CDBG application. Wilson thanked Lynn Kaminski for getting involved with the Christmas in the Village project. Christmas in the Village will be celebrated Saturday, December 8. Village Christmas lights/decorations will be put up on Sunday, December 2. Volunteers welcome. Trustee DeJohn thanked everyone for their warm welcome and is looking forward working with all for the good of the Village. Crew Chief Jeff Kaminski reported that paving work had begun that morning. He was reminded to see if repaving of the South Main extension in front of Goya could be included or scheduled for next year. The sale of the Water Plant is still awaiting a release from a maintenance agreement from the State. In other matters, the Board • Awarded bid for K&L Demolition/Restoration Four (4) bids were received for the K&L Demolition/Restoration Project, a Restore NY funded (90%) project. After full review of all Bids and upon recommendation of the Village Engineer, the Village of Angola Board of Trustees awarded the lowest bid in the amount of $110,000.00 (one hundred ten thousand dollars) from Titan Wrecking & Environmental, LLC Inc. of 262 Woodward Ave. Kenmore, New York contingent upon approval from the State of New York. • Approve payment request to Erie County CDBG for E&R General Contracting Inc. School St. Waterline The Village Board received two bills from E&R General Contacting Inc. totaling $95,803.00 payment in full, for completion of the School Street Maple Street Loop Waterline Replacement Project, and authorized payment of $95,803.00 as payment in full, pending funds to be received from Community Development Block Grant funds from the Erie County as per contracted. • Approved modified and updated extension of the Snow and Ice Control Agreement with Erie County Erie County, pursuant to Comm. 14E-11 dated June 2, 2005, relating to the control of snow and ice on County roads by towns and incorporated villages, entered into a two-year agreement with local municipalities for such purposes, which expired August 31, 2007, at a lane mile reimbursement rate of $2,532.00. It would be in the best interest of Erie County to extend the agreement at a lane mile reimbursement rate increasing by five percent each year for an additional three year period. The Erie County Legislature authorized such extension of the Snow and Ice Control Agreement, as modified and updated, at a lane mile reimbursement rate increasing five percent each year for an additional three year period, to expire August 31, 2010, payable from adopted Division of Highways O&M budgets in amounts as indicated: September 1, 2007 through August 31, 2008 $2,658.60 per lane mile; September 1, 2008 through August 31, 2009 $2,791.53 per lane mile; September 1, 2009 through August 31, 2010 $2,931.11 per lane mile. (The Village of Angola has 2 lane miles of road (Lake Street) that it clears for the County.) • Authorized assemblage application extending Cruise Nights Approved the request for an extension on an Assemblage Permit in accordance with established terms and conditions from Tony Troidl. Cruise Night will continue every Thursday September 1 through September 30, 2007 from 6:00 to 9:00 P.M. with cars parked on North Main Street between Center Street and School Street and music via live performance and/or sound system. Assemblage application requests that North Main Street be closed at 5:30 PM only allowing participating vehicles to enter. • Accepted the Settlement Agreement in the Pinto vs. Village of Angola matter. (No additional information was given.) •Approved a Tire Recycling project for the Village. Additional information to follow. • Approved the repair of the Fire Hall roof for a total of $12,3000. One bid had been received. The roof will be a fully adhered rubber roof to match the roof on the Village Hall. The work to be done as soon as possible. The next meeting of the Village Board will be Monday, September 17 at 7:30 pm. If needed a workshop will be held at 7:00pm. All are invited to attend. Highlights from the Evans Town Board Meeting The Evans Town Board met on Wednesday, September 5, 2007. All members were present. Donna Kraft from Burns Road addressed the Board about code violations in a neighbor’s yard. She had also addressed the Board at the previous two meetings. It appears that nothing has changed in the neighbor’s yard, the junk vehicles are still there. Paul Ryerse, the representative from the Building Department, explained that Chuck LaBarbera had gone out on the inspection of that property so he (Mr. Ryerse) did not have first hand knowledge of the situation. He believed that the vehicles were all registered and the violations were satisfied. Ms. Kraft still had questions about the compliance of the property. Supervisor Robert Catalino suggested that the three of them (Kraft, Ryerse and Catalino) visit the property so that Ms. Kraft’s concerns could be concretely addressed. Cheryl Grassia told the Board we should all be very proud of our EMTs, Fire Departments and Police for the job they had done over the busy Labor Day weekend. Councilman Michael Spence thanked the Parks Department, the Recreation Department and Julie Roach from the Seniors Department for all they did to help make the recent concert at the Town Park a success. Councilman Kathy Bartus congratulated Councilman Spence for his part in the Town’s concert. She also commended the Parks Department for all the improvements that have been made in the parks. People have been noticing the improvements and commenting to her on them. Councilman Paul Cooper reported that Graycliff Conservancy would be holding their annual meeting on Wednesday, September 26 at 6pm at the Graycliff Estate. He also reported that an Energy Fair will be held on Saturday, September 22 from 11am to 6pm at the Brant Fire Hall. The Energy Fair is open to all, free of charge and will provide information on ways to save money in your home. Councilman Karen Erickson announced that Lake Shore Road between Beach Road and Lake Street would be closed through September 17. Supervisor Catalino stated that the Angola Village Board voted to abolish the Village Police department on August 20, 2007. If a petition to hold a permissive referendum was not filed within the allowed 30 days, the Village Police Department would be abolished on September 30 and the Town of Evans would begin providing police services on October 1, 2007. Catalino also remarked that new commercial construction was underway in the Town - Goya Foods, Caro Medical Center and Lakeshore Family Medicine. Catalino also thanked the Parks Department for a job well done again this year. He was not happy, however, with the fact that the County beaches within the Town were only open two times this summer. He would work to see that the situation was remedied for next year. Sandy Brant gave an update on the WalMart Project: We are still waiting for the Draft Environmental Impact Statement. When the Statement is received, "the clock starts ticking". Public Hearings will then be held. Hopefully the Statement will be received in September or October. Catalino also asked Councilmen Erickson and Cooper if they would look into what Most Precious Blood parish plans to do with their now empty portable classroom unit as it may have use as a part of the Historic Society. In other matters, the Board: • Appointed Patricia Buergin of Angola as part time clerk at a rate of pay of $7.15 per hour effective immediately. • Approved an adjustment to the water account of Doris Guest of Church Road in the amount of $313.79 because of a water leak. • Tabled a resolution to promote an Apprenticeship Training Program so that more information could be gathered. • Referred to appropriate Department Heads letters from Francis Mahan, Joe Boerschig and Paul and Anne Becker requesting purchase of parts of paper roads. • Approved the Katherine Graff minor subdivision request for 1421 South Creek Road. The next meeting of the Board will be Wednesday, September 19 at 7:30pm. All are invited to attend. Highlights from the Brant Town Board Special Meeting New Police Chief Appointed The Brant Town Board met for a Special meeting on Friday August 31, 2007 at 7:00 PM, at the Brant Senior Community Building. The Board accepted the resignations of John D. Arrigo as Councilman and William J. Trask Sr. as Town Attorney by a vote of 3 to 1. Councilman Jeff Gier voted nay. Councilman Arrigo’s and Town Attorney Trask’s terms were to end December 31, 2007. The Board also appointed John C. Grennell as Town Attorney to complete the term ending December 31, 2007. Mr. Grennell pledged his oath of office with Town Clerk Thea Ells. The Board appointed David A. Hock part time police officer. He was sworn in by Town Clerk Ells. The Board passed a resolution supporting the efforts of the Animal Alliance of Western New York and the Erie County SPCA through partnering with them to save the lives of cats and dogs through ongoing communication, record keeping and best practices. Supervisor Pero is also authorizied to sign a letter of support for the SPCA from the Town of Brant. Supervisor Pero announced that the Board is invited to attend a meeting at 7:30 PM with FNAGBL Friday September 7th at Holy Cross Lutheran Church concerning the Energy Fair. He also ordered plates for the Memorial Park dedication, Firemen’s appreciation, and donation plates for the park. After an Executive Session, Supervisor Leonard Pero made a statement concerning the procedure from Civil Service and informed those in attendance that the Board sent out 12 cover letters from the civil service list received July 18th and received 8 answers with two that were interested in the position, the interviews were held this evening. We have an officer on the force who qualifies. The Board appointed Michael Felschow as Provisional Chief of Police for the Town of Brant subject to Civil Service approval. The Town Clerk asked for verification of salary/compensation for each of the appointments made during the meeting. The Board set the annual salary for Provisional Chief of Police Michael Felschow at $15,600.00; Officer Dave Hock at $30,000.00 annual and John Grennell at $9,225.00 annual. Supervisor Pero stated that the Chief pay was included in the cover letter and that civil service approved the salary for Officer Hock.
