Highlights from the Angola Village Board Meeting

The Village of Angola Board met on Monday, November 5, 2007. All members were present. Mayor Howard "Hub" Frawley opened the meeting with a moment of silence for former Village Mayor Mike Walters who had passed away the day before.

There were no visitors to address the Board.

Mayor Frawley announced, as reported by the Town Crier and the Buffalo News, that the Senior Housing Project for Angola had been approved. More information will follow as it becomes available.

He wrote a letter to Everybody’s Column in the Buffalo News [published November 11, 2007] in support of Congressman Brian Higgin’s proposed project for Route 5 access to Buffalo; congratulated Jeremy Cournyea on his recent accomplishment of attaining the rank of Eagle Scout; announced Planning Board training that would be taking place in Eden that would help meet mandated educational requirements; suggested the Village needs a representative on the Erie County Sewer Board – Legislator Bob Reynolds will be asked about how the Village can get a representative seat.

Trustee Bill Houston reported on the Joint Board meeting he had attended. The traffic signal at N. Main Street and Beach Road needs to be repositioned. The roads come together at an angle and the signal is straight, the combination, at times, makes it difficult to see the signal. The Town has been asked to fix the problem. Mention was also made about the School Board’s considering going to the full County Civil Service list when looking to fill positions. He thanked National Grid for cleaning around their sub-station on Gowans Road and complimented Jeff Kaminski, DPW Crew Chief, for fixing the Village Clock so that it was able to change with the return of Standard Time. The K&L Building Demolition Project landscaping was completed. Many compliments have been received.

Trustee Denise DeJohn thanked "the girls and the mayor" for putting up the mourning bunting in the Village office to honor former Mayor Mike Walters. Any of the Village employees wishing to attend Mr. Walters funeral on Friday were given permission to do so. The Village Hall would not be closed on Friday. DeJohn reported that at a meeting of the Erie County Association of Governments she learned that there are yearly grants that are available for Justice Courts and records management, etc. She will pass on the information to Lori Szewczyk so that the Village may be able to take advantage of additional grant funds.

Trustee John Wilson thanked DeJohn for the grant funding information and stated that it would help to "continue the identity of the Village, which is important to all of us." Wilson encouraged everyone to vote in the following day’s election. As Fire Department Liaison, Wilson told the Board that, by law, a 3rd Fire Commissioner needed to be appointed. Wilson asked that Scott Russell be considered.

Mayor Frawley reported that the Old Ford Lanes property had been sold for $100 and the new owner was going to be taking it over next month. There is talk of it becoming a Bed and Breakfast. Reid Petroleum (the old Yellow Goose) has a possible buyer for the property. He will not be at the next Village Board meeting because he will be in Albany for a NYCOM Executive Board meeting.

Lt. Don Hepkins reported the Village Police car is in service and has new signage stating that it is serving the Village of Angola. Dispatch has received over 350 calls from the Central Zone. The Central Zone officer stops in and checks each school every day, performs house checks, patrols Herman Park and during each shift the officers attempt to patrol on every street. Hepkins also stated that the officers are aware of the Winter Parking Ban in the Village.

DPW Crew Chief Jeff Kaminski reported that the roof work on the fire hall has been completed.

Fire Commissioner Lynn Kaminski reported that Station 2 had been prepared for Election Day and reminded the Board that a new polling location was needed before next year’s elections. Community Service clubs at the Middle School have been working on refurbishing the wooden cutouts used in the Village Christmas decorations. They would also be meeting on the weekend to work on the Christmas wreaths. Mayor Frawley added that the Village Christmas decorations would be hung by volunteers on Sunday, December 2 at 9am. All volunteers are welcome to meet at Dan’s Restaurant at 8am.

In other matters, the Board:

• Approved a Special Election to be held March 18th 2008 in the Village of Angola to fill an unexpired TRUSTEE term for 1-year

• Authorized the mayor to sign the Statement of Support prepared by the Erie County SPCA and authorized the Village Clerk to forward certified copies of this resolution to the Western New York Delegation, the Town Supervisors and City and Village Mayors of Erie County. The Society for the Prevention of Cruelty to Animals (SPCA) serving Erie County is the lead agency for a grant from the Maddie’s Fund to support community wide collaborations for adoption guarantee organizations, traditional shelters, animal control agencies, and private practice veterinarians working together to end the killing of healthy and treatable shelter dogs and cats. The Angola Village Board and the Animal Control program will support the efforts of the Animal Alliance of Western New York and the Erie County SPCA through partnering with them to save the lives of cats and dogs through ongoing communication, record keeping and best practices.

• Approved the application from Sherry Schuster of "Friends of the Village" to assemble a parade to go from the Commercial Street Fire Hall to Main Street to Center Street ending at the William G. Houston Gazebo on Saturday December 8th 2007 at 1:00pm for the Celebration of Christmas in the Village. Angola DPW, Evans Police, Angola Fire Dept and the NFTA will be notified accordingly.

• Authorized the Clerk-Treasurer to publish, pursuant to law, all necessary notices for the March 18th 2008 Special Village election commencing with the November notice designating offices to be filled.

• Authorized the Village Clerk to send the delinquent tax list to Erie County. The Village of Angola Board of Trustees have certified the statement of the year 2007 unpaid taxes are true and eighty-nine (89) parcels are to be forwarded to the Erie County Department of Finance for collection of sixty-six-thousand-one-hundred-thirty-seven-dollars and ninety-one-cents ($66,137.91)

• Authorized Mayor Howard "Hub" Frawley to sign and execute the Erie County Snow Removal Agreement between the Village of Angola and the County of Erie and authorized the Village of Angola to name Erie County as additional insured as per agreement.

• Authorized Mayor Howard "Hub" Frawley to sign and execute a First Amendatory Agreement with Erie County Department of Environment and Planning, amending the 9/19/07 Agreement of the 2007-2008 CDBG project for the North Main Street sidewalk improvement project, due to the higher bid amount, the funding was increased to $91,663.00.

The next Village Board meeting will be November 19, 2007 at 7:30pm.

Highlights from the Evans Town Board Meeting

The Evans Town Board met on Wednesday, November 7, 2007.

Two Public Hearings were held during the course of the meeting. The first was concerning the 2008 Preliminary Budget and the second concerned the 2008 Angola Fire Protection District Budget. No public comment was made for either hearing.

Councilman Michael Spence reminded all that there is a Leaf Drop-off Site at the Evans Town Park. Residents may drop off their leaves in the roped off area at the basketball courts.

Councilman Kathy Bartus announced that Community Concern is looking for volunteers for their various programs.

Councilman Paul Cooper reminded all to check their smoke detector batteries and replace them as needed. He also noted that a recycling calendar was being prepared and residents should be mindful of how they dispose of energy-saving compact fluorescent bulbs.

Councilman Karen Erickson thanked the Police Department for the excellent job they did handling the bomb threat at the Senior High School earlier in the day.

In other matters, the Board:

• Authorized the Supervisor to sign the Snow Removal Contract with Erie County contingent upon review of the Town Attorney

• Adjusted the water account of Kenneth Gallagher in the amount of $396.50 because of various water leaks

• Appointed Joseph Gian of Derby to the position of full-time Public Safety Dispatcher from the Erie County Department of Personnel Civil Service List, effective November 1, 2007. Full time dispatcher Tina Powell resigned effective October31, 2007.

• Authorized the Supervisor to extend the agreement with Westfield Disposal (The Town of Evans has contracted with Westfield Disposal for trash and recycling disposal service since 2001.) for trash and recycling disposal service for the period January 1, 2007 to December 31, 2007 pursuant to the existing terms and conditions including an "actual cost" adjustment for the increase in landfill rates, and the Town Attorney is hereby directed to prepare the necessary documentation.

• Amended Resolution Number 315 of the year 2007 to read Intermunicipal Agreement instead of a Memorandum of Understanding in the last paragraph.

• Set a Public Hearing for December 5, 2007 at 7:50 p.m. for Proposed Local Law #6 of the year 2007 and 8:00 p.m. for Proposed Local Law #7 of the year 2007at the Evans Town Hall.

Proposed Local Law No. 6 of the Year 2007 entitled "Local Law for Erosion and Sediment Control" and Proposed Local Law No. 7 of the Year 2007 entitled "Local Law to Prohibit Illicit Discharges" collectively, the "Local Laws" have been proposed, which seek to reduce stormwater pollution, enhance water quality, and improve aquatic habitats by requiring that a Stormwater Pollution Prevention Plan be submitted for all land development projects disturbing more than one acre of land, or less than one acre if part of a larger plan of development, and by prohibiting illicit discharges to the Municipal Separate Storm Sewer System ("MS4"). The Local Laws have been drafted using model language from the New York State Department of Environmental Conservation ("DEC") and the New York State Department of State in order to fulfill the MS4 Phase II stormwater management requirements of the National Pollutant Discharge Elimination System as administered by the State Pollutant Discharge Elimination System. The Local Laws shall amend Chapters 178 and 200 of the Code of the Town of Evans ("Town Code") and add a new Chapter 170, entitled Storm Sewers, to the Town Code. All terms used but not defined herein shall have the meanings given to them in § 617.2 of Chapter 6 of the New York Code of Rules and Regulations. The New York State Environmental Quality Review Act ("SEQR") requires that a lead agency be established to undertake, find, or approve any action. In accordance with § 617.6 of Chapter 6 of the New York Code of Rules and Regulations, which outlines the procedure for uncoordinated review of certain unlisted actions, the Town Board may proceed under SEQR as if it were the only involved agency and, therefore, as the lead agency. The approval of the Local Laws by the Town Board (the "Action") constitutes an unlisted action under SEQR. The Town Board must make a determination as to the environmental impact of the Action. All proposed zoning changes must be sent to the Erie County Division of Planning. The Town Board shall conduct an uncoordinated review of the proposed Action under SEQR; authorize an uncoordinated review of the Action; declare itself to be the Lead Agency with respect to the Action; authorize the preparation of a Short Form EAF to be circulated with the Planning Board together with the full text of the Local Law for Erosion and Sediment Control; consider whether or not to issue a negative declaration with respect to adopting the Local Laws during the Public Hearing; and request input from the public on the proposed Local Laws.

The meeting was adjourned in memory of former Angola Mayor Michael Walters. The next work session will be Wednesday, November 14, 2007 at 6pm and the next meeting will be held on TUESDAY, NOVEMBER 20 at 5PM.
