Highlights from the Evans Town Board Meeting The Evans Town Board met on Wednesday, December 5, 2007. Councilwoman Karen Erickson was absent. Several residents addressed the Board regarding an agenda item, a letter from the Mauers requesting the purchase of a portion of the paper road Point Breeze Drive. As other residents have done, the Mauers want to purchase the paper road that abuts their property. This paper road however also abuts Lake Erie Beach Park land. The residents addressing the Board opposed the proposed purchase stating that they were afraid it would privatize the park and it was not consistent with the Town’s Master Plan. The Mauers’ request stated that no parkland was included in the purchase request. The Board referred the letter to the appropriate Department Heads. Councilman Michael Spence reminded all of the Parks Department’s Christmas Lighting and Coloring Contests and the Town’s Christmas in the Park celebration scheduled for Saturday, December 15, 2007 from 1 to 3 pm. Spence also thanked Community Development Director Lori Szewczyk for her help in securing a $49,957.00 grant to improve the Nettlecreek Playground. The grant is a 50/50 matching funds grant and will be used to tear down the old equipment and put up new. Spence also announced that cellphones are working in Derby. Previously, there was a "dead zone" through Derby but the new cell tower is up and operational and cellphones are now working. Councilwoman Kathy Bartus announced that the new 2-1-1 Essential Services number is now active. 2-1-1 is a simple and easy-to-remember number to call when people need help or access to human services. Like 9-1-1, it easily and directly connects the caller to a local/regional 2-1-1 call center. It is not another emergency service access point. The 2-1-1 call center provides direct personal assistance. After an interview with a caller to gain an understanding of specific needs, information and referral specialists provide the caller with detailed information about and referral to appropriate agencies, programs and services. It is a 24-hour, multi-lingual service so people get the help and information they need when they need it. Councilman Paul Cooper announced the Evans Center Canned Food Drive and Christmas in the Village. He congratulated Graycliff and Sandy Brant on the grants that Graycliff recently received. Graycliff is a tremendous asset to our community. Cooper read a letter thanking and commending Police Dispatch, Rural Metro and all involved with the recent emergencies faced by the DiMartino family. On consecutive nights, two different daughters were taken by ambulance to the hospital because of breathing difficulties. Doctors recommend ambulance transport for children with breathing difficulty because their condition can be monitored and breathing facilitated en route.Public Hearings on Proposed Local Law #6 – Stormwater Pollution Prevention and Proposed Local Law #7 – Storm Sewers both yielded public comment. Questions about the measurement of pollution particles, inspection criteria, the complaint process, the Stormwater Management Officer, inconsistency of definitions between the two laws were brought to the Board. All questions were referred to Town Engineers from Wendel Duchscherer for clarification. No action was taken on either law at this meeting. In other matters, the Board: • Set a public hearing for Proposed Local Law #1 of the year 2008 to amend Chapter 200 of the Town Code relating to the Agriculture and Open Space District therein addressed., for January 16, 2008 at 7:20pm. • Adjusted the water account of John Granville in the amount of $127.46 because of various water leaks. • Went on record supporting any effort to regulate that manufacturers of energy saver light bulbs, which are known to contain Mercury, a known hazardous and toxic material, package them in such a way as to give detailed information on the proper disposal of the light bulbs and that retailers post the same hazardous materials information in their stores. • Authorized Robert R. Catalino II, Supervisor of the Town of Evans to support an application filed by the Town of Evans on our behalf to the 2007-08 New York State Department of State - Shared Municipal Service Incentive Grant Program to obtain financial assistance, not to exceed $400,000 (local cash match of $40,000), to offset the cost of merging the Village of Angola Police Department with the Town of Evans Police Department, thereby improving services and reducing costs to all residents. • Authorized Robert R. Catalino II, as Supervisor of the Town of Evans, to file an application with the 21 Century Fund not to exceed $100,000 and upon approval to enter into a project agreement with the Community Foundation of Greater Buffalo for such financial assistance to the Town of Evans for continuation of the Multi-use Lakeshore Pathway. • Appointed Samuel DeJohn of Angola provisional Police Chief at the current salary of $88,722, pursuant to New York State Civil Service Law; and Ernest Masullo of Angola to the position of "LIEUTENANT OF DETECTIVES" in the Town of Evans Police Department at the salary established pursuant to the Collective Bargaining Agreement by a vote of 3 to 1. Michael Spence cast the dissenting vote questioning the interview process, not the appointments, and saying he first saw this resolution this evening. •Appointed Charles Mathewson of Angola to the position of part time laborer at the Senior Center at a rate of $8.00 per hour. • Adopted the Stormwater Management Plan dated October 2007 which addresses Best Management Practices for prevention of pollution to stormwater from municipal operations as required by the New York State Department of Environmental Conservation. • Adopted the Standard Operating Procedures for Pollution Prevention/Good Housekeeping for Municipal Operations dated October 2007 as required by the New York State Department of Environmental Conservation. • Authorized award of the Fire Hydrant Purchase project to Lock City Supply, Inc. in the amount of $36,467.00, contingent upon the Town Attorney’s review of the Contractor’s Bonds and Insurances. • Agreed to reimburse the Erie County Water Authority the costs for all materials to be used as necessary for the Water Meter and Tileset Installation contract (07-1) and Fire Hydrant Replacement contract (07- 2). • Adopted the Stormwater Pollution Prevention Plan fees to effectively cover the cost of doing such business (unfunded mandate) in the Town as outlined • Approved Refreshment Licenses for: Fei Ni D/B/A Derby China King Express; Evans Land Corp D/B/A Grandview Golf Course; Robert Insalaco D/B/A Bobbo’s Tacos & Subs; Robert Insalaco D/B/A Bobbo’s Tacos & Subs Patio; William Connors D/B/A Connors Hot Dog Stand St Pt Marina; and William Connors D/B/A Connors Hot Dog Stand • Approved Refreshment, Amusement and Live Band Licenses for: Michael Slawinski D/B/A Stroh’s Tavern; Thomas Eoannou D/B/A Point Breeze R.V. Resort LLC; Mary Galante D/B/A Herr Place; and Marie Mogavero D/B/A Meadowbrook Rest & Bar Inc The meeting was adjourned in memory of Brenda Chipetta, Lake Shore bus driver who had died in an accident at the bus garage on Monday. The next meeting of the Evans Town Board will be Wednesday, December 19, 2007 at 7:30pm. All are invited.
